Terms and Conditions

1. INTERPRETATION AND VARIATION

1.1 In the Terms and Conditions the following definitions apply:
“Company” means Doria Yoga (London) Limited (trading as OmRLX_International Ltd.).
“Member/Studio User/Customer” means any person that has purchased or made use of one of our yoga packages.
“Yoga packages” means any item that provides the client with access to our products/services or studio facilities.
“Products/services or studio facilities” means any of the yoga studios open to, or products/services offered to, clients of the company as published on our website(s).
“Terms and Conditions” are as defined here.
“Website” means www.doriayoga.com or affiliated websites.

1.2 The Terms and Conditions are incorporated into the online booking system.

1.3 The Company reserves the right to vary or revoke any of the Terms and Conditions from time to time which it may consider necessary or suitable for the regulation of the governance of the studio and the conduct of members. Any such changes will be published on our websites and, until revoked, are binding on members.

1.4 The Terms and Conditions shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

 

2. MEMBERSHIP/STUDIO USER

2.1 Subject to condition 2.2, when a person has purchased a yoga package or used the studio products/facilities/services they shall become a Member of the Studio or a studio user.

2.2 Acceptance of a person as a Member or a studio user is at the discretion of the Company.

2.3 The Company reserves the right to withdraw, suspend or refuse to renew the membership of any member or user whose conduct is, or may deemed to be in the Company’s reasonable opinion, injurious to the character of the studio or amounts to a breach of the Terms and Conditions or where such expulsion is otherwise to be in the interests of the other Members of the Studio. Any Member so expelled shall forfeit all privileges to membership and shall not be entitled to any refund for any period during which his membership is suspended.

2.4 The Studio may run promotional introductory offers from time to time (directly or through an agent i.e Groupon/Living Social). These offers are exclusively for new Members who are not already registered with the Studio and are not for repeat use.

 

3. STUDIO OPENING TIMES

Details of class times at the Studio may vary from time to time. Class times will be published by the Studio on our Website.

 

4. PAYMENT TERMS

4.1 Details of yoga packages are available on our Website(s) or shall be such prices as determined by the Company from time to time.

4.2 Payments for classes at the Studio do not entitle Members to attend classes at any yoga Studio other than those operated by this Company (in the event that they are available).

4.3 Subject to any statutory right of cancellation, payments for classes, class pass fees, monthly subscription fees and annual payments are made non-refundable unless otherwise stated in the Terms and Conditions.

4.4 Workshops, Retreats and Programmes at Doria Yoga are non refundable.

4.5 In the event of the Company cancelling a Retreat/Programme we will refund Members all deposits and payments they have paid. We cannot however compensate Members for airfare or travel costs incurred. In the unlikely event that we must cancel a Retreat/Programme due to force majeure (including but not limited to; weather, natural disaster or political upheaval) we cannot guarantee a refund. To cover these risks, we highly recommend that Members purchase travel insurance.

 

5. PERSONAL BELONGINGS

Personal belongings are brought into the Studio premises at the Member’s risk and the Company does not accept liability for any loss or damage whatsoever to such items. For security reasons Members are advised to take valuables into the studio and not leave them in the kitchen area downstairs.

 

6. FACILITY BOOKINGS

6.1 Co-Ed Classes Online & In-Person – No Refund. No Reschedule.
If you are unable to attend due to a sudden injury, I will be able to provide a full refund or an extension of your pass only upon presentation of a valid doctor’s certificate.
In the unlikely event that I need to cancel the session, I will contact you via email to make alternative arrangements, extend your pass or to refund your payments if you prefer.

6.2 1:1 Classes – For cancellations made with less than 48 hours notice or if you do not turn up for your appointment, you will be charged the full appointment fee in these circumstances.
For cancellations made more than 48 hours you will be able to move your appointment to the next available spot but no refund will be made.
If you need to change your appointment please send me an email at namaste@doriayoga.com, phone calls or text messages will not be taken into account.
If you are unable to attend due to a sudden injury, I will be able to provide a full refund or an extension of your pass only upon presentation of a valid doctor’s certificate.
In the unlikely event that I need to cancel the session, I will contact you via email to make alternative arrangements or to refund your payments if you prefer.

6.3 Courses – For courses and workshops I can only provide a refund (minus a 20% admin fee) for cancellations made more than 28 days before the start date. For cancellations less than 28 days before the course or workshop there will be no refunds or transfers unless: the workshop is full and your place can be filled from a waiting list, or you are sick/injured/pregnant and can provide a doctor’s note. In these cases I will refund the fee, minus a 20% admin fee. All clients are asked to agree to Doria Yoga terms and conditions upon booking a course or workshop. If a course or workshop is cancelled you will be offered either a cash refund or the option of being transferred to an alternative event. Once you have committed to a course or workshop, I recommend that you attend the scheduled number of sessions to get the most out of the programme.

6.4 Our Online Booking Facilities and rules are as follows:
\ Classes can be booked online up to two weeks in advance.
\ All Members with online/studio bookings are advised to arrive only 10 minutes before the class starts. NO ENTRY WILL BE ALLOWED ANY LATER THAN THE CLASS START TIME and no refund will be given.

 

7. USE OF FACILITIES

7.1 A Member is welcome to use the Studio’s facilities. The Studio may at any time withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of the Studio or the Company.

7.2 You must be over 18 years of age to attend any mixed-gender class.

7.3 Anyone under the age of 18 will be refused access to any mixed-gender class.

 

8. FITNESS AND HEALTH

8.1 Members are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. The Studio reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities.

8.2 Members with the following conditions should not attend class: low/high blood pressure and cardiac irregularities. If there is any doubt, the Member should consult his/her doctor. Members must notify the Doria Yoga (trade as OmRLX_International Ltd.) of any circumstances affecting their health which may be exacerbated through continued use of the Studio.

 

9. DRESS & FOOTWEAR

Clothed Yoga – Members are requested to wear comfortable and appropriate clothes to the practice of yoga.
Naked Yoga – Members are encouraged to not wear clothes during any naked yoga practice.
Footwear should be removed on entry to the premises and left right outside the yoga room.

 

10. SAFETY & HYGIENE

10.1 Smoking is not allowed anywhere on the premises.

10.2 No crockery, glass or food is permitted in the room or studio. No pets (unless guide dogs) are permitted on the premises.

10.3 Members are requested not to walk around the Studio or showers barefoot if they have foot complaints (please wear flip flops).

10.4 Members must use the appointed entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these doors for any reason.

10.5 In the event of a fire, Members are asked to make their way to the nearest available exit.

10.6 Remember yoga class is often a very intimate setting and you may practice yoga closer to your fellow yoginis than you prefer due to lack of space or a crowded room. Please mind your personal hygiene. Use Deodorant. Use toothpaste or mouthwash. Brush your hair. Wear clean clothes. Bring a clean mat and clean towel in. These are the minimum requirements of appearing in public in general. Good personal hygiene shows respect to our own self and body first and foremost so it should never be compromised but especially not when others may be subject to your poor hygiene.

 

11. GENERAL GUIDELINES

11.1 Members must at all times observe the Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Members.

11.2 Members are required to give written notice to the Company of any change of address, email or contact number. Failing such notice, all communications shall be assumed to have been received by the Member within 5 days of mailing/emailing to the last address/email address notified to the Company.

11.3 The Company reserves the right to refuse admission to the Studio.

11.4 A person who is not a Member has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any terms of the Membership agreement or use any of the facilities provided by the company.

11.5 The Company may, if a Member so wishes, communicate with the Member by electronic mail (“email”). By providing an email address to the Company, the Member consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Member also accepts any risk that email may not be a fully secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member in this manner.

 

12. PUBLIC RETREATS

12.1 It is the customer’s responsibility to check the reservation and ensure that the particulars contained are correct.

12.2 The customer or client shall pay the Company either in full to confirm a booking, or a non-refundable deposit due for each person or total company fee named in the reservation.

12.3 The balance monies due shall be paid by the individual customer to the Company, for a place or places on a retreat when agreed on booking.

12.4 If payment of either the deposit or the balance is not received by the due date, the Company reserves the right to cancel the reservation and retain the deposit.

12.5 In the event of an individual place cancellation by the customer to a retreat organised by the Company:

– 50% of the total cost of the retreat is refundable up to 120 days prior to retreat start date only.

12.6 Due to situations beyond our control, the Company reserves the right to change bookings and shall inform the customer as soon as possible. Alternative arrangements will be offered but we do not accept responsibility for any costs incurred, including airfare.

12.7 The Company is not held liable for flight costs.

12.8 The Company reserves the right to offer discretionary discounts and this does not affect the status of any guests who have paid the full price and no discount will then become due to them.

12.9 The customer shall not use the property except for permitted use and shall not use the property for any offensive, noisy, dangerous, illegal, entertainment, immoral or improper purposes. The customer shall not do anything which may be a nuisance or annoyance to the Company and its guests, staff or owners.

12.10 The customer shall keep all properties used by the Company, fixtures, fittings, furniture and effects in a clean and good condition and shall replace any articles which are destroyed or missing with articles of a similar kind and of equal value.

12.11 The Company reserves the right at its sole discretion to terminate use of the any property or any of its facilities by the customer in the event of any breach of these terms and conditions. The customer will be required to vacate the property and the Company shall not refund payment or accept any consequential liability damages or loss.

12.12 It is the customer’s responsibility to ensure that he/she has all the relevant travel documentation and arrives at the airport or any other form of transport station in time.

12.13 The Company can accept no responsibility for delay or cancellation of any flights, train, buses or other forms of transport.

12.14 The Company reserves the right to alter any facility accommodation or yoga activity.

12.15 In the event that the customer decides to downgrade their accommodation after monies have been paid, the customer will not be entitled to any refund. If the customer wishes to upgrade the new price will apply.

12.16 The customer must comply fully with all and any health and safety regulations introduced by the Company. The customer must ensure that he/she is medically and physically fit and able to use our facilities and participate in activities. Customers who have injuries or illnesses are advised to seek doctor’s advice if practicing yoga. The Company is not liable for any injuries to the customer in his/her use of our facilities or participation in activities. A customer must always stop and rest if he/she is feeling any pain or sickness and inform the teacher of any previous injuries.

12.17 The Company cannot accept any responsibility for loss or damage of personal possessions or valuables of the customer.

12.18 In the event of a customer having any complaint, then he/she will not discuss this with any third party and shall notify the manager as soon as possible.

12.19 The Company shall not be liable for any failures beyond its control. This covers natural disasters, war, ‘acts of God’, epidemic, closure of airports, civil strife, accidents or failure to perform by third parties, including suppliers and subcontractors.

12.20 The Company accepts no liability for loss, damage, injury or illnesses which may be received during the customers stay or travelling to and from a Doria Yoga Retreats.

12.21 We recommend that all customers have adequate travel, cancellation and medical insurance for the duration of the trip. The Company can accept no liability for customers.

12.22 I acknowledge and agree that if the facilitators perceive my presence as detrimental to the other participants (including but not limited to staring at others with insistence), it may result in immediate exclusion from the course without compensation or refund.

12.23 The Company is not responsible for any medical costs for participants on the retreat.

 

12.1 PRIVATE RETREATS

12.1.1 It is the customer’s responsibility to check the reservation and ensure that the particulars contained are correct.

12.1.2 The customer or client shall pay the Company either in full to confirm a booking, or a non-refundable deposit in the sum of 50% of the total amount, due for each person or total company fee named in the reservation.

12.1.3 The balance monies due shall be paid by the individual customer to the Company, for a place or places on a retreat when agreed on booking.

12.1.4 If payment of either the deposit or the balance is not received by the due date, the Company reserves the right to cancel the reservation and retain the deposit.

12.1.5 In the event of an individual place cancellation by the customer to a retreat organised by the Company:

– 50% of the total cost of the retreat is refundable on teaching fee only (Flight tickets, accommodation, and airport transfer fees will not be refunded) up to 8 weeks prior to retreat start date only.

 For cancellations made with less than 8 weeks notice, you will be charged the full appointment fee in these circumstances.

12.1.6 Due to situations beyond our control, the Company reserves the right to change bookings and shall inform the customer as soon as possible. Alternative arrangements will be offered but we do not accept responsibility for any costs incurred, including airfare.

12.1.7 The Company is not held liable for flight costs or airline strikes. 

12.1.8 It is the customer’s responsibility to ensure that he/she has all the relevant travel documentation and arrives at the airport or any other form of transport station in time.

12.1.9 The Company can accept no responsibility for delay or cancellation/strike of any flights, train, buses or other forms of transport.

12.1.10 The Company reserves the right to alter any facility accommodation or yoga activity.

12.1.11 No changes can be made to the teacher’s accommodation after the deposit has been paid, Ex. downgrade.

Customers who have injuries or illnesses are advised to seek doctor’s advice if practicing yoga. 12.1.17 I acknowledge and agree that if the facilitators perceive my presence as detrimental to the other participants (including but not limited to staring with insistence), it may result in immediate exclusion from the course without compensation or refund.

12.1.18 The Company is not responsible for any medical costs for participants on the retreat.

 

13. LIMITATION OF LIABILITY

13.1 The Company cannot be held responsible for any service or equipment not being available for whatever reason. The Company reserves the right to make alterations to the types of facilities provided, without notice and in its absolute discretion and the Company shall not be liable for any loss occasioned by such alterations except in so far as loss is by law incapable of exclusion.

13.2 It is the Member’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme that they follow or class that they attend. Members accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any programme or class. The Company accepts no liability for loss or damage to property or injury of Members on the Studio premises or outside the Studio except in so far as such loss, damage, or injury is by law incapable of exclusion.

 

14. LIABILITY WAIVER

Members agree to the following:

14.1 Members are participating voluntarily in a class, workshop or retreat offered by the Company. Members recognise that yoga requires physical exertion that may be strenuous and cause physical injury, and they are fully aware of the risks and hazards involved. Members represent and warrant that they are physically fit and they have no medical condition that would prevent their full participation and they agree to assume full responsibility for any risks, injuries or damages, known or unknown, which they might incur as a result of participating in the program.

14.2 Members understand that they may receive physical assists or adjustments to enhance or correct their body posture during class by either the teacher or an assistant in class. Members will take accountability for alerting the teacher and assistant of any injury or impairment in advance before the class begins or if they do not want to receive any assists.

14.3 Members knowingly, voluntarily and expressly waive any claim they may have against the Company and its individual teachers for injury or damages that they may sustain as a result of participating in the program.

14.4 Members, their heirs or legal representatives forever release waive, discharge and covenant not to sue for any injury or death caused by their negligence or other acts.

14.5 Members agree that the Company is in no way responsible for the loss or damage of any of their belongings while they attend any class.

14.6 Members have read the above release and waiver of liability and fully understand its contents. Members voluntarily agree to the terms and conditions above.

 

15. ONLINE/IN-PERSON CLASS RULES

15.1 No latecomers.

15.2 In order to foster an environment of equality, participants are required to adhere to the mandatory nudity policy, ensuring that everyone is on an equal footing. However, women are permitted to wear bottoms during their menstrual cycle for their comfort and convenience.

15.3 For online sessions, it is essential that participants have their cameras turned ON, remain visible throughout the session, and actively participate.

15.4 Any form of sexual or sensual energy is NOT accepted and it will result in being removed from the class and being reported.
15.5 Staring/staring with insistence.
15.6 The link to join the class will be provided to participants 60 minutes prior to the scheduled session start time.
15.7 Participants are responsible to check their email “SPAM” folder in case the invite doesn’t make it to their inbox.
15.8 Participants are required to establish a connection and be prepared to commence the session at least 5 minutes before the scheduled start time. The Zoom room will be made available approximately 15 minutes prior to the commencement of the class.
15. 9 Participants are required to ensure that their internet connection meets the minimum bandwidth requirements stated below before making any bookings:
  • For high-quality video: 800kbps/1.0Mbps (up/down)
  • For gallery view and/or 720p HD video: 1.5Mbps/1.5Mbps (up/down)
  • Receiving 1080p HD video: 2.5Mbps (up/down)
  • Sending 1080p HD video: 3.0Mbps (up/down)

To verify your internet bandwidth, it is recommended to use Speedtest or a similar tool. Please be aware that refunds will not be provided if the minimum bandwidth requirements are not met.

15.10 During the booking process, participants are requested to select their respective time zone. The system will then automatically convert the session times accordingly.

15.11 If participants are still uncertain about the corresponding time in their location, it is recommended to utilise an online time zone calculator for clarification.

15.12 Participants are advised to ensure that they have thoroughly tested the Zoom or similar system well in advance of attending the class. It is important to note that any issues or difficulties encountered while using the system or any lack of technical skill are the sole responsibility of the participant and not the organization conducting the class.

15.13 We strive to maintain a positive atmosphere, and any form of misconduct will lead to immediate exclusion from the class and future bookings. Instances of misconduct will be reported, and no refunds will be provided.

15.14 Unfortunately if these conditions cannot be met, even for technical reasons, you will be removed from the session.
